The Status of Cannabis Legalization in WV

In recent West Virginia cannabis reform, The House Committee on Health and Human Resources passed House Bill 2756. If officially passed, this bill would require medical marijuana be added to the controlled substance monitoring database.

On April 19, 2017, West Virginia passed Senate Bill 386, creating the West Virginia Medical Cannabis Act. Despite some delays, the state issued licenses to cannabis businesses in 2019 and 2020, moving closer to providing medical cannabis to eligible patients.

This Act also provides funding for medical cannabis research for serious medical conditions as well as revenue to the Substance Abuse Fund and the Division of Justice and Community Services. In addition, it will provide grants to law enforcement agencies for training on drugs and addiction. A 10% tax applies to medical cannabis purchases for patients or caregivers.

Now, the state has over 7,000 registered medical cannabis patients and 9 operating licensed medical cannabis dispensaries.
